Many proposals are currently pending in Congress and
many more will likely be introduced that would allow
certain undocumented persons to earn legal status in
the United States.  These proposals have not yet been
passed, and it may take a long time for any of them to
become law. Still, Immigration service-providers are
advised to begin considering what implementation of

How Should An Undocumented Foreign National Prepare NOW
for Legalization?

Undocumented foreign nationals will likely need to prove at least three
things:

(1) Identity
(2) Physical presence or residency in the United States
(3) Good moral
character

Become a Board of Immigration Appeals (BIA) Recognized
Agency

Non-profit groups without immigration lawyers can represent foreign
nationals before the immigration authorities if they, or their staff, are
recognized by the Board of Immigration Appeals (BIA) as having adequate
information, knowledge and experience in immigration law.   This
accreditation will be immensely useful for groups considering legalization

Warn Others of Notarios and Immigration Consultants

Advise communities to be cautious with anyone who offers help filing
immigration applications with the government.  There are many fraudulent
services out there.   They charge fees for poor representation. They
often ruin applications, which can cause the deportation of applicants.  
Many will exploit legalization to sell their services.
