Webinar One: Introduction to Asylum Law

In this webinar, we will focus on the basics of asylum law. We will guide you through the concepts of past persecution and well-founded fear, the five protected grounds, and establishing a nexus to these grounds. We will use hypotheticals to explain eligibility for asylum under the law.  

 


Webinar Two: Credibility and Corroboration

In many cases, success in an asylum application turns on whether the adjudicator finds the applicant to be credible. This webinar will discuss the legal standards for assessing credibility and which factors the adjudicator can and cannot consider when determining whether an applicant is credible. We will provide specific pointers on how practitioners can best prepare their clients to provide testimony to minimize the risk of an adverse credibility finding. We will also review the legal standards for corroborating an asylum claim, including a discussion about which evidence can support a claim and how representatives can argue for asylum eligibility even in the absence of corroborating evidence.  

 


Webinar Three: Asylum Procedures and Navigating New Regulations on Asylum Processing

In this webinar, we will discuss affirmative and defensive asylum procedures and the differences between them. We will review recent changes to asylum law and procedure, including regulations regarding asylum processing for those who arrive at the southern border and express a fear of return. We will also discuss the Circumvention of Lawful Pathways rule and the Securing the Border rule, which create severe challenges for asylum seekers. Finally, we will provide an overview of the screening process (credible fear and reasonable fear) for those subject to expedited removal and reinstatement of removal.

 


Webinar Four: Navigating Bars to Asylum

Nov. 11 | 2-3:30 p.m. ET | CA MCLE 1.5

The mandatory bars to asylum found in the statute can prevent even those who face persecution in their country from being granted asylum. We will cover the persecutor bar to asylum, the terrorism-related inadmissibility grounds, and firm resettlement. We will also discuss the one-year filing deadline which requires an asylum seeker to file for asylum within one year of their last entry into the United States unless they qualify for an exception. We will also discuss withholding of removal and protection under the Convention Against Torture as alternative forms of relief for those subject to a bar to asylum.
