CLINIC Joins Amicus Brief Opposing Asylum Ban

VICTORY! On July 6, 2020, the Ninth Circuit affirmed the preliminary injunction against the Third Country Transit Rule.

CLINIC, represented by the Center for Gender and Refugee Studies and joining over forty other nonprofit legal services organizations and law school clinics, filed a brief in the Ninth Circuit urging the court to block regulations limiting the availability of asylum. The rule, if implemented, would bar from asylum virtually any person who transited through another country on their journey to the United States. The amicus brief argues that the Third Country Transit Rule all but eliminates asylum in the United States, and describes how travel through multiple countries does not undermine the legitimacy of asylum claims.
