Thousands of Afghan nationals have been granted asylum, either affirmatively or defensively, since 2021. Thousands more are eligible to adjust status through the Afghan Special Immigrant Visa (SIV) process. In this webinar, CLINIC staff will discuss hot topics and current trends in applying for adjustment of status for Afghan nationals, including considerations for individuals who are eligible to adjust status based on an asylum grant or an approved SIV petition, applicability of the Terrorism-Related Inadmissibility Grounds (TRIG) at the adjustment stage, how to address polygamy and non-biological children, who should be included as derivatives of a principal’s Form I-485, and potential issues in filing Form I-131 and traveling with Advance Parole.
