The Effect of Travel on Naturalization Eligibility and LPR Status

Applicants for naturalization must meet certain residence and physical presence requirements. Travel outside the U.S. may affect eligibility for citizenship and in some circumstances may lead to a finding of abandonment of LPR status. This workshop will cover issues related to the residence and physical residence requirements, including: maintaining lawful permanent residence status; when travel abroad may break the continuity of residence; exceptions for spouses of U.S. citizens, members of the armed services, and others; and when a conditional resident can file for naturalization. The session will also include a discussion of abandonment of residence and steps that can be taken to avoid an abandonment finding.
