CLINIC joined with 17 other organizations that serve asylum seekers to urge the Ninth Circuit to uphold a preliminary injunction in favor of asylum seekers affected by Customs and Border Protection’s (CBP) so-called “metering” policy. “Metering” is a practice by which immigration officials artificially limit the number of asylum seekers who are physically permitted to access a port of entry and officially begin the asylum process. The brief shows how metering is not related to any real operational constraints faced by CBP, but rather is a practice motivated by animus toward asylum seekers designed as an arbitrary obstacle to seeking asylum in the United States.
